CUHK LAW GBA Forum – "Private International Law in the Greater Bay Area: An Empirical Assessment of the Qianhai Court Judgements"

CUHK LAW has introduced a Greater Bay Area (GBA) Forum which aims to contribute to the development of the GBA. The next seminar "Private International Law in the Greater Bay Area: An Empirical Assessment of the Qianhai Court Judgements" will be presented by Professor Chao Xi, Professor and Outstanding Fellow of the Faculty of Law, on 7 June 2022.

Drawing upon a dataset of all publicly accessible court judgements handed down by the Qianhai Court during the 2015-2020 period, Professor Xi's collaborative research empirically examines how private international law is applied in the Court's cases involving Hong Kong or Macau elements. The seminar reports preliminary empirical findings on selected private international law issues, including the choice of law, party autonomy, proof of foreign law, parallel litigation, and ordre public. The Qianhai Court's practices shed light on how domestic courts approach private international law in the context of the Greater Bay Area that features three civil and common law jurisdictions.
